The terms of this agreement (“Terms of Service”) govern the relationship between you and TUFAPPS YAZILIM SANAYİ VE TİCARET LİMİTED ŞİRKETİ, a Turkish company doing business as Snowball Games (hereinafter “Tufapps,” “Snowball Games,” “Us,” or “We”) regarding your use of Snowball Games’ games, store, websites, and all related services (the “Service”).

Use of the Service is also governed by our Privacy Policy and other relevant policies, which are incorporated herein by reference.

Before using our Service, including browsing any website or accessing any game provided by Snowball Games, you must agree to these Terms of Service and our Privacy Policy. You may be assigned a guest account for initial access to the Service, and you may be required to create a registered account to fully use the Service (collectively “Account”). This includes, but is not limited to, game accounts and Snowball Games accounts. By creating or using an Account or otherwise accessing the Service, you confirm that you are of legal age in your country of residence. If you are not, your parent or legal guardian must review and accept these Terms of Service on your behalf.

BY INSTALLING, USING, OR ACCESSING THE SERVICE IN ANY MANNER, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, USE, OR ACCESS THE SERVICE. THE USE OF THE SERVICE IS VOID WHERE PROHIBITED.

Snowball Games may, at its sole discretion, revise, update, or alter portions of these Terms of Service, the Privacy Policy, and other relevant policies at any time. Such changes will be posted on the Service. By continuing to use the Service after these changes have been posted, you agree to the revised terms and policies. If you disagree with any part of the current or revised Terms of Service, Privacy Policy, or other policies, your authorization to use the Service will be terminated, and you must cease all use of the Service immediately.

1. Using the Service

1.1. Your right to use the Service

Subject to your acceptance and ongoing compliance with these Terms of Service and any other relevant Snowball Games policies, you are granted a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Service for your personal, non-commercial entertainment purposes only. You agree not to use the Service for any other purposes.

The following restrictions apply to your use of the Service:

• You are fully responsible for any unauthorized use of the Service by minors. This includes any use of your payment methods (such as credit cards) by minors.
• You may not purchase, sell, rent, or give away your Account, nor create an Account using a false identity or information, or on behalf of someone else. You may not use the Service if you have previously been removed or banned by Snowball Games.
• You may not use the Service to advertise, solicit, or transmit any commercial advertisements, including chain letters, junk mail, spam, or repetitive or misleading messages to anyone.

Login Information and your Account

You may be required to choose a password for your Account or use other credentials to access your Account (“Login Information”). You must not share your Account or Login Information with anyone, nor allow anyone else to access your Account or take any action that could compromise the security of your Account. If you become aware of or reasonably suspect any security breach, including but not limited to any loss, theft, or unauthorized disclosure of your Login Information, you must immediately notify Snowball Games and change your Login Information. You are solely responsible for maintaining the confidentiality of your Login Information and are accountable for all activities that occur under your Login Information, including any purchases, whether or not they are authorized by you. You are responsible for all actions taken through your Account.

Snowball Games reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by third parties that a username violates their rights.

Use Limitations

Any use of the Service that violates these Use Limitations is strictly prohibited, can result in the immediate revocation of your limited access rights, and may subject you to legal liability.

You agree that you will not, under any circumstances:

• Engaging in any behavior that Snowball Games determines to be against the intended spirit or purpose of the Service, or misusing Snowball Games’ support services.
• Using, or being involved in using, any cheats, exploits, automation software, emulators, bots, hacks, mods, or any unauthorized third-party software that modifies or interferes with the Service, any Snowball Games game, or the gaming experience provided by Snowball Games.
• Altering or attempting to alter any files that are a component of the Service or any Snowball Games game without explicit written permission from Snowball Games.
• Interfering with, disrupting, or negatively impacting the normal operation of the Service, or acting in a way that adversely affects other users’ experience when using the Service or playing Snowball Games games. This includes activities such as win trading, manipulating rankings, exploiting service errors for an unfair advantage, and any actions that misuse or go against the intended design of the Service.
• Disrupting, overloading, or aiding in the disruption or overloading of any computer or server used to deliver or support the Service or any Snowball Games game environment.
• Initiating, assisting, or participating in any kind of attack, including but not limited to distributing viruses, conducting denial of service attacks on the Service, or other attempts to disrupt the Service or any other user’s ability to enjoy the Service.
• Share or post any content that is abusive, threatening, obscene, defamatory, libelous, or offensive in any manner, including content that is racially, sexually, religiously, or otherwise objectionable. Avoid engaging in toxic behavior, such as repeatedly posting unsolicited information.
• Share or post any content that includes nudity, excessive violence, or offensive material, or links to such content.
• Attempt to harass, abuse, or harm, or advocate or incite harassment, abuse, or harm against another person or group, including Snowball Games employees, moderators and customer service representatives.
• Distribute any material or information through the Service that infringes on any copyright, trademark, patent, trade secret, privacy right, publicity right, or any other rights of any person or entity, or impersonate any person, including but not limited to Snowball Games employees.
• Attempt to reverse engineer, decompile, disassemble, or decipher any software or other intellectual property used to provide the Service or any Snowball Games game, or obtain any information from the Service or any Snowball Games game through any means not explicitly authorized by Snowball Games.
• Attempt to obtain or solicit Login Information, other account credentials, or personal details from other users of the Service or any Snowball Games game.
• Gather or distribute anyone’s private information, including personal identification details (in any form, including text, image, or video), identification documents, or financial data through the Service.
• Engage in or facilitate gambling, betting, or any similar activities using any Snowball Games game, where prizes or rewards are at stake (whether directly or indirectly). This includes wagering on match outcomes in which you are a participant, regardless of the presence of a fee or stake.
• Use the Service in any way that contravenes export control laws, anti-money laundering regulations, economic sanctions, or similar legal frameworks, including but not limited to those enforced by the United States and/or the European Union.

Snowball Games reserves the right to determine what behavior it considers to violate the rules of use or to be contrary to the intent or spirit of these Terms of Service or the Service itself. Snowball Games may take appropriate action as a result, which can include terminating your Account and banning you from accessing the Service, in whole or in part.

1.2. Suspension and Termination of Account and Service

WITHOUT LIMITING ANY OTHER REMEDIES, SNOWBALL GAMES MAY RESTRICT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE, OR PORTIONS OF IT, WITH OR WITHOUT NOTICE, IF (i) YOU ARE, OR SNOWBALL GAMES SUSPECTS THAT YOU ARE, VIOLATING THESE TERMS OF SERVICE; OR (ii) FOR ANY ACTUAL OR SUSPECTED ILLEGAL OR IMPROPER USE OF THE SERVICE. THIS MAY RESULT IN THE LOSS OF YOUR USERNAME, AVATAR, AND ANY BENEFITS, PRIVILEGES, EARNED VIRTUAL ITEMS, AND PURCHASED VIRTUAL ITEMS ASSOCIATED WITH YOUR ACCOUNT, WITHOUT ANY COMPENSATION FROM SNOWBALL GAMES.

IN ADDITION TO OTHER REMEDIES, WE MAY LIMIT, SUSPEND, OR TERMINATE THE SERVICE AND ACCOUNTS OR PARTS THEREOF, RESTRICT ACCESS TO OUR GAMES AND SITES, AND THEIR CONTENT, SERVICES, AND TOOLS, REMOVE HOSTED CONTENT, AND TAKE TECHNICAL AND LEGAL STEPS TO PREVENT USERS FROM ACCESSING THE SERVICE IF WE BELIEVE THEY ARE CREATING RISK OR POTENTIAL LEGAL LIABILITIES, INFRINGING ON THIRD PARTIES’ INTELLECTUAL PROPERTY RIGHTS, OR ACTING INCONSISTENTLY WITH THE LETTER OR SPIRIT OF OUR TERMS OR POLICIES. ADDITIONALLY, IN APPROPRIATE CIRCUMSTANCES AND AT OUR SOLE DISCRETION, WE MAY SUSPEND OR TERMINATE ACCOUNTS OF USERS WHO REPEATEDLY INFRINGE ON THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.

SNOWBALL GAMES RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR A PERIOD OF 90 DAYS.

Snowball Games reserves the right to discontinue the Service or any specific game or part of the Service at any time. Upon such discontinuation, your right to use the Service, or any part of it, will be automatically terminated. In such cases, Snowball Games is not obligated to provide refunds, benefits, or any other compensation to users for the discontinued Service. Termination of your Account may include restricting your access to the Service or any part of it, including any content submitted by you or others.

You may terminate your Account at any time and for any reason by following the instructions on the Service or game clients, or by informing Snowball Games that you wish to terminate your Account at [email protected].

2. Ownership

2.1. Games and Service

Snowball Games retains complete ownership and all proprietary rights over the Service, which includes, but is not limited to, all games, titles, software code, themes, objects, characters, character names, storylines, dialogue, catchphrases, concepts, artwork, animations, sound effects, musical compositions, audiovisual effects, methods of operation, moral rights, documentation, in-game chat logs, character profiles, recordings of gameplay using a Snowball Games game client, as well as the Snowball Games game clients and server software. All intellectual property rights and other proprietary rights related to the games and the Service are exclusively held by Snowball Games.

2.2. Accounts

NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF SNOWBALL GAMES.

2.3. Virtual Content

Snowball Games holds ownership, licenses, or other rights to use all content that appears within the Service or Snowball Games games. Regardless of any provision stated otherwise, you agree that you do not possess any rights or titles to any content that appears within the Service. This encompasses, but is not limited to, virtual items, content, features, goods, services, or currency found in or originating from any Snowball Games game, whether earned in-game or purchased, as well as any other attributes tied to an Account or stored within the Service.

3. User Content

3.1. Submission of User Content

“User Content” refers to any communications, images, sounds, and all other materials, data, and information that you or other users upload or transmit through a Snowball Games game client or the Service, including but not limited to chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent, and warrant that such transmission or submission is: (a) accurate, and not confidential or misleading; (b) not in violation of any laws, contractual obligations, or third-party rights, and that you have obtained permission from any third party whose personal information or intellectual property is included in the User Content; (c) free from viruses, adware, spyware, worms, or other malicious code; and (d) you acknowledge and agree that any personal information within such content will be processed by Snowball Games in accordance with its Privacy Policy.

3.1.1. Content Screening

Snowball Games is not responsible for the conduct of any user who submits User Content, nor does Snowball Games take responsibility for monitoring the Service for inappropriate content or behavior. We do not, and cannot, pre-screen or monitor all User Content. You use the Service at your own risk. By accessing the Service, you might encounter User Content that you find offensive, indecent, or contrary to your expectations. You accept all risks associated with the use of any User Content available through the Service. Snowball Games may, at its discretion, have representatives or automated systems monitor and/or record your interactions and communications (including chat text) while you use the Service.

By agreeing to these Terms of Service, you provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy regarding the transmission of any User Content, including but not limited to chat text or voice communications.

Snowball Games reserves the right, at its sole discretion, to review, monitor, restrict, edit, delete, disable access to, or otherwise make any User Content (including your User Content) unavailable without notice, for any reason or no reason at any time. Should Snowball Games decide to monitor the Service, this does not imply any responsibility for User Content nor an obligation to modify or eliminate any inappropriate User Content. We have the authority, but not the obligation, at our sole discretion, to edit, decline to post, or remove any User Content.

3.2. Information Use by Other Users of the Service

3.2.1. Public Discourse

The Service may offer forums, blogs, and chat features where you can share User Content, including your thoughts and comments on specific topics. Snowball Games cannot ensure that other users will not utilize the ideas and information you share. If you have ideas or information that you want to keep confidential and not be used by others, do not post them on the Service. Snowball Games has no responsibility to review, use, or compensate you for any ideas or information you choose to share.

3.2.2. Responsible For Your Own Content

You are fully responsible for the content you share on, through, or in relation to the Service and for any information you provide to others. Snowball Games reserves the right to reject, refuse to post, or remove any User Content for any reason or no reason, including, but not limited to, content that Snowball Games, at its sole discretion, believes breaches these Terms of Service.

3.2.3. Your License to Snowball Games

You hereby grant Snowball Games an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license, including the right to sublicense and assign to third parties, to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, provide electronic access to, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice in any way, your User Content and all modified and derivative works thereof in connection with our provision of the Service, including for marketing and promotional purposes. You also grant Snowball Games the right to authorize others to exercise any of the rights granted to Snowball Games under these Terms of Service. Furthermore, you grant Snowball Games the unconditional, irrevocable right to use and exploit your name, likeness, and any other information or material included in any User Content without any obligation to you. Except as prohibited by law, you waive any rights of attribution and/or moral rights you may have in your User Content, even if it is altered or changed in any manner. Snowball Games does not claim ownership rights in your User Content, and nothing in these Terms of Service is intended to restrict any rights you may have to use and exploit your User Content. Snowball Games is under no obligation to monitor or enforce your intellectual property rights in your User Content.

3.3. User Interactions

You are solely responsible for your interactions with other users of the Service and any other parties you engage with through the Service and/or Snowball Games games. Snowball Games reserves the right, but has no obligation, to get involved in any disputes between you and other users. You agree to fully cooperate with Snowball Games in investigating any suspected illegal, fraudulent, or improper activity, including granting Snowball Games access to any password-protected areas of your Account.

If you have a conflict with one or more users, you release Snowball Games (and its officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands, and damages (both actual and consequential) of every kind and nature, known and unknown, arising from or in any way related to such disputes.

4. Fees and Purchase Terms

4.1. Purchases

Through the Service, you may purchase, using “real world” money, a limited, personal, non-transferable, non-sublicensable, and revocable right to use (a) virtual currency, including but not limited to virtual cash or diamonds, for use in Snowball Games games; (b) virtual in-game items, content, or features; and (c) other goods or services (points a–c are collectively referred to as “Virtual Items”). You are permitted to purchase Virtual Items only from us or our authorized partners through the Service and not through any other means.

You expressly agree that we will begin fulfilling the purchase agreement for Virtual Items or any other digital content immediately, before the expiration of any statutory withdrawal period defined by applicable laws. By giving your explicit prior consent, you acknowledge that the content you purchase will be delivered to you before the withdrawal period ends, and you thereby waive your statutory right of withdrawal.

Snowball Games reserves the right to manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice. To the fullest extent permitted by applicable law, Snowball Games shall not be liable to you or any third party if Snowball Games exercises any of these rights.

The transfer of Virtual Items is prohibited except where explicitly authorized within the Service. Apart from such explicit authorization, you may not sell, purchase, redeem, or otherwise transfer Virtual Items to any person or entity, nor attempt to do so. This includes, but is not limited to, transactions with Snowball Games, other users, or any third party.

ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE, EXCEPT AS REQUIRED BY APPLICABLE LAW.

The provision of Virtual Items for use in Snowball Games games is a service provided by Snowball Games that begins immediately upon Snowball Games accepting your purchase.

4.2. Payment of Fees

You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. Snowball Games reserves the right to adjust the pricing for Virtual Items available through the Service at any time. YOU ACKNOWLEDGE THAT SNOWBALL GAMES HAS NO OBLIGATION TO ISSUE REFUNDS FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE ANY MONETARY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, REGARDLESS OF WHETHER THE CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

5. Updates to the Service

You understand that the Service is continually evolving. Snowball Games may require you to accept updates to the Service and any Snowball Games games you have installed on your device or computer. You acknowledge and agree that Snowball Games can update the Service and Snowball Games games at any time, with or without notifying you. Additionally, you may need to update third-party software periodically to access the Service and play Snowball Games games.

6. Disclaimer of Warranties

WITHOUT LIMITING SNOWBALL GAMES’ LIABILITY UNDER SECTION 7 BELOW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ANY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. SNOWBALL GAMES DOES NOT GUARANTEE THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT ANY GIVEN TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT ANY DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE GAMES WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties. Therefore, some of the above disclaimers may not apply to you.

7. Limitation of Liability; Sole and Exclusive Remedy; Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, SNOWBALL GAMES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOST REVENUE, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THESE TERMS OF SERVICE OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER SNOWBALL GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT NOT PROHIBITED BY LAW, SNOWBALL GAMES’ LIABILITY WILL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SNOWBALL GAMES IN THE SIX (6) MONTHS IMMEDIATELY PRIOR TO THE DATE YOU FIRST ASSERT A CLAIM. YOU AGREE THAT IF YOU HAVE NOT PAID ANYTHING TO SNOWBALL GAMES DURING THIS TIME PERIOD, YOUR ONLY REMEDY (AND SNOWBALL GAMES’ EXCLUSIVE LIABILITY) FOR ANY DISPUTE WITH SNOWBALL GAMES IS TO STOP USING THE SERVICE AND CANCEL YOUR ACCOUNT.

NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR LIMIT OR EXCLUDE ANY LIABILITY ARISING FROM SNOWBALL GAMES’ GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FOR DEATH OR PERSONAL INJURY CAUSED BY SNOWBALL GAMES’ NEGLIGENCE OR FRAUD.

You agree to indemnify, defend, and hold Snowball Games, along with its officers, directors, agents, subsidiaries, joint ventures, and employees, harmless from any claims, demands, damages, or other losses, including reasonable legal fees, made by any third party arising out of or related to your use of the Service or any violation of these Terms of Service by you. This indemnification obligation does not apply if the infringement of rights is not due to your intentional or negligent actions.

8. Dispute Resolution

You and Snowball Games agree that the dispute resolution processes outlined in this agreement will govern any disputes or claims related to these Terms of Service, the Privacy Policy, or the Service. Disputes encompass any type of claim, including legal, equitable, or statutory claims. These dispute resolution processes will apply even if you cease using your Account, delete your Account, or discontinue using the Service. They will also apply to disputes that arose before this agreement was made.

8.1. Informal Dispute Resolution

You must attempt to resolve any dispute informally with Snowball Games for at least thirty (30) days before initiating arbitration. The informal dispute resolution process begins when you provide Snowball Games with written notice of the dispute via email at [email protected].

9. Severability

You and Snowball Games agree that if any section of these Terms of Service or the Snowball Games Privacy Policy is declared illegal or unenforceable, either in whole or in part, by a court with proper authority, that specific provision will be ineffective only within that jurisdiction and only to the extent of the invalidity or unenforceability. This will not impact the validity or enforceability of the provision in other jurisdictions or the remaining parts of the terms, which will remain fully effective and enforceable.

10. General Provisions

10.1. Assignment

Snowball Games reserves the right to assign or delegate these Terms of Service and/or the Snowball Games Privacy Policy, either in whole or in part, to any individual or entity at any time, with or without your consent. You are prohibited from assigning or delegating any rights or obligations under these Terms of Service or the Privacy Policy without obtaining prior written consent from Snowball Games. Any unauthorized assignment or delegation by you will be considered null and void.

10.2. Supplemental Policies

Snowball Games may issue additional policies related to specific services, including but not limited to forums, contests, or loyalty programs. Your use of such services is subject to compliance with those specific policies as well as these Terms of Service.

10.3. Entire Agreement

These Terms of Service, together with any supplemental policies and any documents explicitly incorporated by reference (including the Snowball Games Privacy Policy), represent the entire agreement between you and Snowball Games. This agreement supersedes all prior agreements, understandings, and communications, whether electronic, oral, written, or based on custom, practice, policy, or precedent, related to the subject matter of these Terms and the Service.

10.4. No Waiver

Snowball Games’ failure to require or enforce strict compliance by you with any provision of these Terms of Service or the Snowball Games Privacy Policy, or its failure to exercise any rights under them, does not constitute a waiver of Snowball Games’ right to enforce such provision or right in the future.

A waiver by Snowball Games of any provision, condition, or requirement of these Terms of Service or the Snowball Games Privacy Policy will not be deemed a waiver of any future obligation to comply with such provision, condition, or requirement.

Unless expressly stated in these Terms of Service, no representations, statements, consents, waivers, or other acts or omissions by Snowball Games shall be considered a modification of these Terms of Service, nor will they be legally binding, unless documented in a physical writing, signed by both you and an authorized officer of Snowball Games.

10.5. Notices

We may notify you through postings within our games, on snowball.games, via email, or through any other communication methods using the contact information you provide to us. Any notices you give or are required to give under these Terms of Service or the Snowball Games Privacy Policy should be sent to [email protected].

10.6. Equitable Remedies

You acknowledge that the rights granted to Snowball Games under these Terms of Service are unique and irreplaceable, and any loss of these rights would cause Snowball Games irreparable harm that cannot be compensated by monetary damages alone. Therefore, Snowball Games is entitled to seek injunctive or other equitable relief (without the requirement to post any bond, surety, or prove damages) in the event of any breach or anticipated breach by you.

You irrevocably waive any right to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any Snowball Games game, the use of any advertising or other materials related to the Service, or the exploitation of the Service or any content or other material displayed through the Service. You agree to limit your claims to monetary damages, if any, as specified in Section 7.

10.7. Force Majeure

Snowball Games will not be responsible for any delay or failure to fulfill its obligations due to circumstances beyond its reasonable control. This includes, but is not limited to, events such as natural disasters, wars, acts of terrorism, riots, embargoes, actions by civil or military authorities, fires, floods, accidents, strikes, or shortages in transportation, fuel, energy, labor, or materials.
